TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using Megin ("the Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Refund Policy, and any other policies referenced herein. If you do not agree, do not use the Service.

These Terms apply to all users, including personal trainers ("Trainers") who create accounts and manage clients, and clients ("Members") who are invited to the platform by their trainer.

2. Service Description

Megin is a SaaS (Software as a Service) platform for personal trainers. The platform includes:

  • Client registration, tracking, and profile management.
  • Workout programming and assignment.
  • Session scheduling and calendar management.
  • Body measurement tracking and progress charts.
  • Nutrition tracking and meal management.
  • Weekly progress reports and push notifications.
  • Package and payment tracking.
  • Blog management and fitness tools.

Service scope, features, and pricing may be modified with prior notice. Active features within a current subscription period are maintained until the end of that period.

3. Account Registration & Security

To use Megin, you must create an account. You are responsible for:

  • Providing accurate, current, and complete registration information.
  • Maintaining the security and confidentiality of your password.
  • All activities that occur under your account.
  • Notifying us immediately at info@megin.ai of any unauthorized access.

You must be at least 18 years old to create an account. Individuals under 18 may only be added as "linked members" by a parent or guardian. One person may only create one account.

4. Trainer Responsibilities

Trainers who use the platform additionally agree to:

  • Process client data only within the scope of training services and in compliance with applicable data protection laws.
  • Not export, share with third parties, or commercially exploit client data outside the platform.
  • Bear sole responsibility for the health appropriateness of workout and nutrition programs they provide.
  • Ensure their use of the platform complies with all applicable laws and regulations.
  • Not exceed the client limit of their subscription plan.

5. Subscription Plans & Payments

Megin offers free and paid subscription plans:

  • Free: Up to 3 clients, core features.
  • Plus: Up to 10 clients, advanced features (charts, nutrition tracking, reports, notifications, finance).
  • Pro: Up to 50 clients, all features (progress photos, badges, blog, risk score, Instagram cards).
  • Subscription fees are charged monthly or annually, inclusive of applicable taxes.
  • Payments are processed through PayTR. We do not store full card details.
  • Subscriptions auto-renew. Cancel at least 3 days before renewal to prevent charges.
  • Price changes are communicated at least 14 days before the next billing cycle and do not affect the current period.
  • Non-payment for 30 days may result in service suspension or downgrade to Free plan.

6. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal or unauthorized purpose.
  • Provide false, misleading, or fraudulent information.
  • Attempt to reverse-engineer, decompile, or extract source code.
  • Use automated tools (bots, scrapers) to access the Service.
  • Transmit viruses, malware, or any harmful code.
  • Harass, threaten, or abuse other users or Megin staff.
  • Upload content that infringes third-party intellectual property rights.
  • Attempt to access other users' data without authorization.
  • Use the platform to send spam or distribute malicious content.

7. Health Disclaimer

IMPORTANT HEALTH NOTICE

Workout programs, nutrition suggestions, and fitness content on the platform are for general informational purposes only and do not constitute medical advice.

If you have any health conditions, chronic illnesses, or injury history, consult your doctor before starting any exercise program.

Megin does not guarantee the medical appropriateness of programs provided by trainers. We are not liable for health-related harm. Trainers are not authorized to provide medical advice (dietary therapy, rehabilitation, disease treatment).

8. Intellectual Property

  • The platform's design, source code, algorithms, logo, trademarks, domain name, and all software components are the exclusive property of Megin.
  • Content uploaded by users (workout programs, blog posts, photos) remains the intellectual property of the respective user.
  • By uploading content, you grant Megin a license to use, store, and display that content for the purpose of providing platform services.
  • Workout programs assigned to members are for personal use only and may not be shared with third parties.

9. Limitation of Liability

  • The Service is provided "as is" without warranties of any kind.
  • Megin does not guarantee uninterrupted, error-free, or vulnerability-free operation.
  • Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.
  • Megin is not liable for indirect damages, lost profits, data loss, or reputational damage.
  • Planned maintenance will be announced in advance. Emergency maintenance may be communicated afterward.

10. Account Suspension & Termination

By Megin: We may suspend or terminate your account for Terms violations, illegal activity, security threats, fraudulent information, non-payment (30+ days), or third-party rights infringement.

By you: You may close your account at any time from platform settings or by emailing info@megin.ai. Active subscriptions continue until the end of the current billing period. Refund conditions are governed by the Refund Policy.

11. Force Majeure

Natural disasters, war, terrorism, pandemics, government actions, infrastructure failures, energy outages, cyberattacks, and similar unforeseeable, unpreventable events beyond the parties' control constitute force majeure. Obligations are suspended during force majeure events.

12. Modifications to Terms

Megin reserves the right to update these Terms. Material changes (payment terms, rights limitations) will be communicated at least 30 days in advance via email and/or in-app notification. Continued use after changes take effect constitutes acceptance.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey. Disputes shall be resolved by the Consumer Arbitration Committees (within monetary limits) and the Antalya Consumer Courts.

14. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
